The Helmsley Plan
In accordance with Regulation 26 of the Town and Country Planning (Local Planning) (England) Regulations 2012, notice is hereby given that Ryedale District Council adopted the Helmsley Plan with main modifications made pursuant to Section 23(3) of the Planning and Compulsory Purchase Act 2004 (as amended) on 9 July 2015. The Helmsley Plan forms part of the Development Plan for the Ryedale District Local Planning Authority Area.
The Helmsley Plan has been jointly prepared with the North York Moors National Park. It allocates sufficient land to meet both the housing and employment requirements for the town up to 2027. It also contains a suite of policies to guide various forms of development and to manage change in the town. It supports the implementation of Ryedale District Council's Local Plan Strategy, which was adopted in 2013 and provides the planning strategy for the District out side of the North York Moors National Park. It has been assessed by an independent Planning Inspector, who concluded that the Helmsley Plan, along with the recommended Main Modifications, satisfies the requirements of Section 20(5) of the Planning and Compulsory Purchase Act 2004 (as amended) and meets the criteria for soundness in the National Planning Policy Framework.
Any person aggrieved by the Helmsley Plan may make an application to the High Court under Section 113 of the Planning and Compulsory Purchase Act 2004 on the grounds that either:
i) The Helmsley Plan is not within the Appropriate power of the local authority; or
ii) A procedural requirement has not been complied with.
Any such application must be made promptly and in any event, no later than six (6) weeks from the date on which the Helmsley Plan was adopted (i.e. no later than 20 August 2015).
This Statement, the Helmsley Plan and its accompanying Sustainability Appraisal Report (incorporating the requirements of Strategic Environmental Assessment) are available for inspection at the following locations:
